Ancient Japan

This article reports on the origin of class society and state formation in Japan. The author analyzes the causes for the social differentiation in wozhen communities in the beginning of our era. He says, that the social status of people was marked by tattoo in the beginning of the first century A.D. The scientist distinguishes primary causes for the emergence of monarchal rule and describes the phenomenon of female rulers in the Japanese states. The author analyzes the specific features of class society development in Japan. He comes to the conclusion, that between the first century B.C. and the third century A.D. the formation of the civil community state was under way. It was a typical development in the early slave-owning period, when the state had no specific paraphernalia for oppression, but power was being alienated from the people.

The year Tenpyō Shōhō 1 as narrated in the court chronicle Shoku Nihongi was one of the most momentous years in the eighth century, an era teeming with dramatic political intrigue, rebellions and succession disputes. Corresponding roughly to the year 749 in the Julian calendar, it saw the abdication of the Emperor Shōmu and the accession of his daughter Abe no Naishinnō, the first female Crown Princess, as the Empress Kōken.  Shōmu declared himself the slave of the Three Treasures at Tōdaiji, and the mysterious and mighty kami Hachiman entered the Nara capital. The year was the occasion for two changes of nengō, or era name, first from Tenpyō 21 to Tenpyō Kanpō 1, then to Tenpyō Shōhō 1. The following complete translation, the first into English or any other Western language, provides a direct window into the mid-eighth century and highlights crucial events of the Nara period in a way which has not been provided before.

In this article the data of the Chinese and Korean sources concerning an early form of the state (community–state) in ancient Japan (the first states of southwest Japan and their state associations during 1st – 3rd centuries A.D.) are analyzed. It is specified that as a result of extensive researches, scientists have come to a conclusion that communities–states (“city-state”) are a universal form of the state of antiquity and the Middle Ages at a stage of formation of early statehood in Europe, Africa, America and Asia, including ancient Japan. Process of formation of communities–states is analyzed in connection with a sinoykizm of communities, formations of chiefdoms in which, in connection with process of a politogenesis, an early form of the state appeared.
The main state bodies of communities-states in ancient Japan are characterized. On the basis of it the conclusion about components of a form of the state (the form of government, a political regime and a form of the state system) is drawn.

В данной статье анализируются сведения японских источников о Восточном походе государя Дзимму и основании династии и государства Ямато в Центральной Японии в сопоставлении с результатами археологических исследований древнеяпонских памятников материальной культуры периода позднего яёй и раннего периода кофун с целью определения времени основания Ямато. Также анализируются сообщения корейских хроник с целью обнаружения косвенных свидетельств, позволяющих датировать время основания государства Ямато. Кроме того приведены сообщения китайских династийных историй о создании государства в Центральной Японии. Результаты археологических исследований позволяют скорректировать хронологию древней Японии, и, на основе циклических обозначений 60-летнего цикла из древнеяпонских письменных источников, дают возможность предложить исправленные датировки времени Восточного похода Дзимму и его царствования в качестве первого государя Ямато. Главным результатом данного исследования является вывод о том, что, на основании результатов археологических исследований и косвенных свидетельств корейских источников, Восточный поход Дзимму был осуществлён в конце III века н.э. (294-300 гг.), а основание династии и государства Ямато произошло в начале IV века (в 301 г.). Государь Дзимму правил 16 лет (301-316 гг.).

In this article, researches of the Japanese, Western, Soviet and Russian scientists on history of the ancient Japanese state Yamato are analyzed. It is found out that studying of the Yamato history in Japan has begun in the early Middle Ages period. However truly scientific analysis of ancient Japan’s events has appeared in the Meiji period in connection with spreading in this country of the researches’ methodology of the western historical science. In the western countries and Russia the studying of ancient Japan history has begun in the second half of the 19th century and continues still. However these researches were disturbed by the wrong official chronology which, as the Japanese scientists have found out and some western Japanologists have supported, there was done more ancient to please to political ambitions of early medieval rulers of Japan. On the basis of archaeological excavations materials it was succeeded to determine that the statehood in the Central Japan was created at a turn of the 3-4th centuries. As a result of the 20th century’s researches it was succeeded to reconstruct completely the ancient  Japanese chronology of the 4th – the first half of the 5th centuries.
Formation of the main scientific spheres of a research of history of Japan (including ancient Japan) belongs to the first quarter of the 20th century. Thus Social-Economic, Historical-Legal and Cultural-Historical schools arisen. In the second half of the 20th – early 40s of the 20th century the Historical-Materialistic school also amplified both in the Soviet Japanology, and in the Japanese science. Freedom of historical researches was established in Japan during the second half of the 20th century after defeat of the Japanese empire in World War II. However it has led to distortions and emergence of the hypercritical school in researches. As a result, materials of sources about the first rules of Yamato have been announced by an invention. Thus, Japan has actually been deprived of the ancient history. This gap began to be filled with different hypotheses, similar to the so-called “theory of horseriders”.
Recently these negative moments began to be overcome gradually. Though degree of study of the Yamato history in the Russian historical science isn’t big enough.

В данной статье анализируется, в связи с изменениями в источниках и развитием системы уголовного законодательства, процесс появления и развития клас-сификации преступлений в древнем и раннесредневековом японском праве, на что в VII веке начинает влиять китайское уголовное право, рецепция которого начинается в дан-ном столетии. Выяснено, что с периода ранней государственности преступления дели-лись на тяжкие и «лёгкие», а от тяжести преступного деяния зависела тяжесть наказания. Возможно, какие-то изменения в уголовно-правовом регулировании были осуществлены на рубеже V–VI вв. правителем Бурэцу (499–506 гг.). В связи с установлением связей двора Ямато с династией Суй в начале VII в. в Японии появляются тексты китайских за-конов и заимствуется классификация особо тяжких преступлений на восемь категорий. Закрепление при новой китайской династии Тан (с 618 г.) классификации особо тяжких преступлений на «Десять зол» приводит к тому, что в первых японских сводах законов второй половины VII века, образцом для которых послужили китайские законодатель-ные акты, также стала применяться классификация «Десяти зол», а также выделялась не-кая группа «семи преступлений» (досл. «основных правонарушений семь недопустимо-стей). Однако в начале VIII века японское уголовное право вернулось к суйской клас-сификации особо тяжких преступлений на «восемь злодеяний», помимо выделения ме-нее тяжких и нетяжких преступлений. In this article the data of sources concerning an early form of the state (community–state) in ancient Japan during the late 3rd – early 4th centuries are analyzed. Process of formation of communities–states (which researchers call ‟small states”) is analyzed in connection with a sinoykizm of communities, formations of chiefdoms in which, in connection with process of a politogenesis, an early form of the state appeared.
At the beginning of the 4th century, the communities of central Japan united into the Yamato federation. On the basis of it the conclusion about components of a form of the state (the form of government, a political regime and a form of the state system) is drawn.

The article analyzes such a form of state as world power (empire). It is determined that for significant periods in the history of the state, many territories were united within the framework of the imperial state to ensure economic and political stability. The typology of empires is characterized.
The process of forming the Japanese state as a tellurokratic one (land state), as well as attempts to go beyond the Japanese archipelago and create a maritime (colonial) empire (talassocracy) in the period of antiquity, the Middle Ages, new and modern times is analyzed.

Монография посвящена малоизученному периоду в истории Японии – эпохе среднего Ямато (конец IV – V вв.). В это время происходят важные события. В древнеяпонском обществе существовали три класса и три сословия, присущие любому древнему обществу. Государство Ямато, установив прочные союзные отношения с древнекорейским государством Пэкче и конфедерацией южнокорейских общин Кая, начинает активно вмешиваться в военно-политические дела Южной Кореи, воюя против южнокорейского государства      Силла и северокорейского государства Когурё. Ямато возобновляет дипломатические связи с южно- китайскими династиями. Идёт массовая миграция бегущих от неурядиц на континенте китайцев и корейцев на Японские острова. Переселенцы были носителями письменности, научных и технических знаний. В результате, древнеяпонское общество, государство, культура и этнос стали развиваться под сильным влиянием континентальных традиций. Период среднего Ямато – это время расцвета древнеяпонского общества и государства.

Le Kokon chomon-jû est un recueil d’anecdotes (setsuwa) compilé au milieu du 13ème siècle par un fonctionnaire de rang moyen de la cour impériale, Tachibana no Narisue. Cet ouvrage imposant (il ne rassemble pas moins de 700 anecdotes) présente une organisation systématique : les histoires se succèdent par ordre chronologique et sont classées en vingt sections thématiques, chacune de ces sections s’ouvrant sur une courte préface qui présente le thème dans son contexte historique ou mythique.
Notre étude a pour objet la section consacrée à la poésie japonaise (waka), qui occupe une place éminente dans le recueil, entre littérature et musique. Nous proposons une traduction annotée des 52 anecdotes de cette section, en laissant de côté les 36 anecdotes considérées comme des ajouts postérieurs à la compilation de l’ouvrage. Deux anecdotes en particulier consignent la relation détaillée de réunions poétiques, le Concours d’œillets de l’impératrice douairière Senshi, qui s’est tenu en 986, et la Réunion célébrant le grand âge de fin de printemps à Shirakawa, organisée en 1172 par Fujiwara no Kiyosuke. Nous proposons une traduction des procès-verbaux (kiroku) de ces deux réunions, que Narisue a très vraisemblablement consultés, afin d’illustrer le travail de remise en forme auquel il s’est livré. En analysant la section consacrée au waka dans son ensemble, nous avons cherché à mettre en évidence les motivations qui auraient pu guider Narisue dans la sélection des anecdotes, notamment la vision de la poésie qu’il aurait souhaité présenter ou les enseignements qu’il aurait voulu transmettre.
Pour la plupart, les anecdotes étudiées ont trait à la correspondance poétique des hauts dignitaires, offrant ainsi de nombreux exemples des usages de la poésie comme mode de communication à la cour : des poèmes sont composés pour adresser ses vœux de longévité à l’empereur, pour évoquer le souvenir agréable d’un divertissement, pour exprimer sa gratitude, ses félicitations ou ses reproches. Le support sur lequel est calligraphié le poème (papier de qualité, tissu…), tout comme l’objet qui peut l’accompagner (en général un rameau fleuri), participe à l’élégance de l’ensemble. Bien souvent, Narisue consigne les poèmes échangés sans indication permettant de comprendre en quoi ils sont remarquables à ses yeux. On peut néanmoins supposer que c’est leur élégance, ou, plus encore, leur à-propos, qui ont leur ont valu d’être sélectionnés.
Si Narisue ne se livre à aucune critique d’ordre esthétique, il ajoute parfois de brèves remarques personnelles qui apportent un éclairage sur sa pensée. Elles témoignent notamment d’une foi bouddhique sincère : Narisue affirme ainsi à plusieurs reprises qu’il convient de placer la voie du Bouddha au-dessus de toutes les préoccupations du siècle, y compris les préoccupations artistiques. D’autre part, on perçoit au fil des anecdotes une admiration empreinte de nostalgie pour un passé où le prestige de l’empereur et de la noblesse n’était pas encore remis en cause par les clans guerriers. Pour Narisue, il était probablement important de montrer que la culture de la cour et ses traditions s’étaient transmises jusqu’à son époque, résistant aux troubles militaires et aux bouleversements politiques qui ont marqué l’entrée du pays dans le Moyen Age.

Six episodes—the Jomon, Yayoi, Tohoku Yayoi, Satsumon and Ainu, Okhotsk, and Gusuku—of agricultural development are examined. These events involve both indigenous adaptations as well as migration and diffusion to and within the Japanese archipelago. All but Jomon subsistence adaptations began as a result of migration and diffusion. Jomon populations engaged in niche construction/anthropogenesis that ranged from annual plant encouragement and probably management, lacquer tree (Toxicodendron verniciflua) and nut tree (Castanea crenata and Aesculus turbinata) management, and probable domestication of barnyard millet and soybean as well as cultivation of bottle gourd and hemp and possible cultivation of Perilla and adzuki. These characteristics place the Jomon in a middle ground that is neither hunting and gathering nor traditionally conceptualized agriculture. A brief comparison with China shows late Upper Paleolithic and Early Neolithic/Early Jomon similarities that can inform discussions about agricultural origins. The Okhotsk raised pigs, grew a few crops, hunted and gathered; this culture also does not fit traditional definitions of an agricultural economy. The other episodes involve forms of agriculture similar to those found in mainland East Asia.

The Old Japanese edicts in Shoku Nihongi have been intensively if not exhaustively studied. Remarkably, the readings that Motoori Norinaga assigned to them in the eighteenth century are essentially in place still today. Senmyō, due to Norinaga’s prescribing of the canon, has come to be the categorization for these sixty-two imperial rescripts. However, little to no attention has been paid either in Japan or the West to a larger number of Old Japanese edicts in senmyōtai appearing in the later National Histories. In addition, the four ninth-century official court histories inscribed in classical Chinese -- Nihon Kōki, Shoku Nihon Kōki, Nihon Montoku Tennō Jitsuroku, and Nihon Sandai Jitsuroku -- have received nothing like the interest that has been devoted over the years to Nihon Shoki and Shoku Nihongi. Stylistically these later senmyō are very much like those in Shoku Nihongi, inscribed in Old Japanese with large and small characters.

The article is devoted to the study of the little-studied period in the history of ancient Japan – the period of the so-called “eight rulers”, who in the official chronology and genealogy were represented as emperors of Yamato state, who replaced each other on the throne as a successive descending line of male descendants. However, the careful study of the materials of the primary sources that were used in the compilation of «Kojiki», «Nihon-shoki» and «Kuji-honki» shows that these were men who lived and ruled at the same time (in the second half of the 3rd – the first quarter of the 4th centuries [corrected chronology]), and six of them belonged to the same generation. On the basis of this, it was concluded that they were local rulers, local lords who controlled separate territories in central Japan, which, apparently, formed an alliance of independent states (confederation), consisting of small territorial states and independent communities-states (depending on the strength and status of each of the eight rulers). This study is devoted to the analysis of the events of this period and the organization of the Yamato confederation during the second half of the 10s – first half  of the 20s of the 4th century [corrected chronology]).

In this article data of the Japanese, Chinese and Korean sources on aggravating and attenuating circumstances in the criminal law of ancient and early medieval Japan (1st – early 8th centuries) are collected and analyzed with respect thereto – the law-enforcement practice and legal acts regulating criminal legal relations of this institutes of the criminal law during Yamato period (4th – mid. 7th centuries) and the initial period of “the state of laws” (Jap. ritsu-ryō kokka, mid. 7th – early 8th centuries) are given.

Вопрос о происхождении японцев и этнической принадлежности их предков до конца в современной науке не решён. Новейшие методы, прежде всего, генетические, позволяют лучше понять процессы этногенеза древних японцев, тем не менее, неправильное истолкование результатов исследований нередко используется, в том числе, и для достижения политических целей. Так, во второй половине XX века появилось несколько близких гипотез, которые пытаются объяснять “корейские” элементы древнеяпонского этноса и черты древнеяпонской культуры завоеванием Японских островов в IV веке н.э. корейцами тунгусо- маньчжурского происхождения (людьми пуё, когурё или пэкче). Однако “корейские” элементы и черты на самом деле имеют гораздо более древнее происхождение.

В статье собраны и проанализированы сведения японских источников о половых преступлениях в государстве Ямато (IV–VII вв.), в связи с этим – приведена правоприменительная практика и нормативно- правовые акты, регулирующие уголовно-правовые отношения в сфере половых преступлений в древней и раннесредневековой Японии.
In this article, the materials of the Japanese sources on the sexual crimes in the Yamato state (IV–VII centuries) are collected and analyzed, in this connection – the law enforcement practice and the normative legal acts, that regulate a criminal-law relationship in sphere of the sexual crimes in ancient and early Japan are given.

The Seventeen-Article Constitution traditionally said to have been written in 604 c.e. by a crown prince Shōtoku, provides a series of ethical instructions addressed to his subjects. By and large, these instructions are grounded on a Confucian understanding of rulership and describe how a state should function; what the relationship between subjects and officials should be like; what values should be dominant. In the very first lines, Shōtoku gives the status of the highest value to the harmony among people, and this idea will be repeatedly mentioned later in the text of the document. Hereafter appealing to the monuments of the Confucian classics, step by step, Shōtoku actualizes the five Confucian constant virtues, making it possible to reconstruct the image of the ideal state, which Shōtoku describes.

В «Уложении семнадцати статей», составленном в 604 г. наследным принцем Сётоку, приводится ряд этических наставлений, обращенных к его подданным. В общем и целом, эти наставления представляют собой ряд конфуцианских по духу максим, освещающих вопросы о том, как должно функционировать государство; о том, что из себя должны представлять отношения между всеми подданными и чиновниками; о том, какие ценности должны быть главенствующими. В первых же строках статусом высшей ценности Сётоку наделяет согласие между людьми, о чем впоследствии неоднократно будет сказано в тексте документа. Однако на этом Сётоку не ограничивается: обращаясь к памятникам конфуцианской классики, шаг за шагом он актуализирует пять конфуцианских постоянств, благодаря чему становится возможным реконструировать образ идеального государства, о котором говорит Сётоку.

В последние годы были получены новые археологические, антропологические и генетические доказательства, подтверждающие древнюю миграцию на Японские острова этнических групп населения Южного Китая. Вывод о миграции выходцев из Южного Китая через Южную Корею на Японские острова находит подтверждение в генетическом материале японцев. Формирование древнеяпонского этноса связано с миграцией из Южного Китая этнических групп, носителей гаплогруппы O и рисоводства, с чем в Японии связан переход к производящей экономике и появление культуры яёй.

During the pre-state period in primitive Japan, the marriage relations underwent development from an endogamy pairing in the precommunity with the ban of sexual communications between men and women of different generations to the partial agamiya, isolation of sexes and orgiastic promiscuity holidays in collective, then to orgiastic attacks out of collective – that, finally, led to the establishment of the full agamiya and emergence of the exogamy what is connected with the emergence of dual-patrimonial (dual-group) marriage and the dual-patrimonial
organization which led to an exogamic pairing. With transition to neighbour’s community, the big family stood apart, and marriage gets the form of dislocal marriage named tsumadoi. The further trend of development of family is connected with transition from matrilineal genus
to the patrilineal genus and emergence through cross-cousin marriage to exogamic marriage with broad extra patrimonial communications.
With emergence of the first states in southwest Japan (in the 1st century AD) and in the Central Honshu (at the turn of the 3rd–4th centuries AD) the institute of marriage was fixed legally. But the matrimonial relations long time remained under regulation of norms of the customary law (legal customs). Legislative regulation of the matrimonial relations for the first
time has appeared only in normative-legal acts of the middle – the second half of the 7th century and in Taihō-ritsu-ryō code of laws of the early 8th century.
