Aanleiding voor deze bijdrage is de publicatie van ‘Richtsnoeren met betrekking tot de uitlegging en toepassing van Richtlijn 93/13/EEG betreffende oneerlijke bedingen in consumentenovereenkomsten’ door de Europese Commissie op 22 juli 2019. Daarin benadrukt de Commissie het belang van effectieve rechtsbescherming door de nationale (civiele) rechter. Informatie is daarbij cruciaal: niet alleen moeten consumenten hun rechten kennen en kunnen uitoefenen in rechte, ook moet de rechter de noodzakelijke beoordeling kunnen uitvoeren, zo nodig ambtshalve. In de praktijk komt het voor dat professionele wederpartijen van consumenten rechterlijke toetsing proberen te omzeilen. In deze bijdrage worden ‘procedurele sancties’ besproken die de rechter in dat geval ter beschikking staan.
