www.BlueGolf.com is the online information sites provided by BlueGolf, LLC ("BlueGolf"), consisting of information services and content provided by BlueGolf, affiliates of BlueGolf and third parties (hereinafter "Sites" or "BlueGolf Sites"). Your use of the Sites constitutes your agreement to the terms, conditions and notices below ("Terms of Use"). IF YOU DO NOT AGREE WITH THESE TERMS OF USE, YOU ARE NOT AUTHORIZED TO USE THE BLUEGOLF SITES AND MUST NOT ACCESS OR USE IT. BlueGolf reserves the right to change, modify, add or remove portions of these Terms of Use at any time. Please check this page periodically for any modifications. Your continued use of the BlueGolf Sites following the posting of any changes means your agreement to and acceptance of the changes.
Ownership. All content included on BlueGolf Sites (including site layout, design, text, images, graphics, video and audio content) are the property of BlueGolf, its affiliated companies or licensors and are protected by United States and international copyright and trademark laws. You may not publish, copy, display, distribute, transmit, perform, modify, create derivative works from, or sell any information, products or services obtained from the BlueGolf Sites, in whole or in part, except as otherwise expressly permitted under applicable law or as expressly authorized by BlueGolf in these Terms of Use.
Permitted Use. The content and software on the BlueGolf Sites may be used as an information, entertainment and/or registration resource. In addition, BlueGolf hereby authorizes you to view, copy, download, and print for personal use only any content on the BlueGolf Sites. Such personal use is subject to the following conditions: (i) content may be used only for non-commercial, informational purposes and may not be posted or distributed, (ii) the content may not be modified, and (iii) copyright, trademark and other proprietary notices may not be removed. This permission does not extend to materials owned by BlueGolf licensors. Except as expressly stated in these Terms of Use or as otherwise expressly authorized by BlueGolf, you may not duplicate, download, publish, modify or otherwise distribute (including through the use of frames or deep links) the material on the BlueGolf Sites. You may not obtain information from BlueGolf Sites for any type of commercial use. Furthermore, you may not copy, reproduce or distribute the design, layout or functionality of the BlueGolf Sites, the BlueGolf logos or other design elements or software. Any use of the BlueGolf Sites content not described herein is strictly prohibited. You also shall not (and shall not allow any third party to) copy, modify, create a derivative work from, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the software or data contained in any BlueGolf Site. You agree not to modify any software for a BlueGolf Site in any manner or form, nor to use modified versions of such software, including (without limitation) for the purpose of obtaining unauthorized access to the BlueGolf Sites. You agree not to access the BlueGolf Sites by any means other than through the interface that is provided and authorized by BlueGolf. You may not engage in systematic retrieval of data or other content from the BlueGolf Sites to create or compile, directly or indirectly, a collection, compilation, database or directory without written permission from BlueGolf, nor may you mirror on your own site any pages of any of the BlueGolf Sites. You may not use automated means (including but not limited to scripts and third-party tools) to interact with the Sites in any way (this includes, but is not limited to: creating accounts, modifying profiles, entering a tournament, following events, obtaining golf course information and viewing course tours). You may not use automated means (including but not limited to harvesting bots, robots, parser, spiders or screen scrapers) to obtain, collect or access any information on the Sites or of any User for any purpose.
BlueGolf may provide areas on the BlueGolf Sites, in which users may post communications. You understand that all information (including your member name or user name), data, text, software, audio, photographs, graphics, video, messages, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not BlueGolf, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the BlueGolf Sites. BlueGolf does not control the Content posted via the BlueGolf Sites and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the BlueGolf Sites, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will BlueGolf be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the BlueGolf Sites. You further understand that the internet has no geographical boundaries, and you therefore agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.
BlueGolf does not claim ownership of any Content submitted and/or posted by you on any BlueGolf Sites. However, by submitting and/or posting any Content to the BlueGolf Sites, you grant BlueGolf a royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display the content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, for the full term of any rights that may exist in such Content and to sublicense such rights through multiple tiers of sublicenses. You also permit any subscriber to access, display, view, store and reproduce such content for personal use.
You may not post information or material to the BlueGolf Sites that violates the rights of any third party or contains a virus or other harmful component, nor may you use language or engage in any activity that is threatening, abusive, vulgar, discourteous or unlawful. BlueGolf reserves the right to remove or edit messages or material submitted by users. You may not use the BlueGolf Sites for sale, trade or other commercial purposes, except as expressly authorized by BlueGolf in these Terms of Use.
You are responsible for your own communications and are responsible for the consequences of their posting. You may not: post copyrighted material, unless you are the copyright owner or have the permission of the copyright owner to post it; post material that reveals trade secrets, unless you own the trade secrets or have the permission of the owner; post material that infringes on any other intellectual property rights of others or on the privacy or publicity rights of others; post material that is obscene, defamatory, threatening, harassing, abusive, hateful or embarrassing to any other person or entity; post sexually-explicit material; post advertisements or solicitations of business; post chain letters or the like; or impersonate another person.
Keep in mind that other users will have access to material you post to the BlueGolf Sites, and they might copy, modify or distribute it. By posting information or material to such Sites, you warrant and represent that you own or otherwise control all of the rights to the content and that public posting, and use of the posted information or material by BlueGolf or any other user will not infringe or violate the rights of any third party.
As a convenience to our members, we may provide links to third-party web sites. The linked sites are not under our control, and we make no representations as to the quality, suitability, functionality or legality of any sites to which we may provide links. You hereby waive any claim you might have against BlueGolf with respect to such sites.
In addition, you may order services through the BlueGolf Sites from other persons not affiliated with BlueGolf ("Seller"). For example, you may choose to register for an event on the BlueGolf Sites. All matters concerning the services desired from a Seller, including but not limited to purchase terms, payment terms, warranties, guarantees, maintenance and delivery, are solely between you and the Seller. BlueGolf makes no warranties or representations whatsoever with regard to any goods or services provided by Sellers. You will not consider BlueGolf, nor will BlueGolf be construed as, a party to such transactions, whether or not BlueGolf may have received some form of revenue or other remuneration in connection with the transaction. You agree that BlueGolf will not be liable for any costs or damages arising out of such transactions, either directly or indirectly.
BlueGolf and/or third parties may, from time to time, send e-mail messages to you containing advertisements, promotions, etc. BlueGolf makes no representation or warranty with respect to the content of any such e-mail messages or any goods or services which may be obtained from such third parties, and you agree that neither BlueGolf nor such third party shall have any liability with respect thereto. You further agree to receive certain periodic communications from BlueGolf such as registration confirmation emails, newsletters, content, messages, and announcements, and that these communications are considered part of your access of the BlueGolf Sites and services and that you may not be able to opt out of receiving such communications in every instance.

You are responsible for maintaining the confidentiality of your login ID and password (your "registration"). You shall be responsible for all uses of your registration, whether or not authorized by you. You agree to immediately notify BlueGolf of any unauthorized use of your registration. You further represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. You also agree to: (i) provide true, accurate, current and complete information about yourself as submitted to BlueGolf, and (ii) maintain and promptly update your registration information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or BlueGolf has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, BlueGolf has the right to immediately suspend or terminate your account and refuse any and all current or future use of the BlueGolf Sites or related products and services (or any portion thereof). BlueGolf makes every effort to protect individual privacy and personal information, and is particularly concerned about child privacy. Parents of children under the age of 13 who wish to allow their children access are required to provide their consent for any registration. By creating such a registration involving your child under the age of 13, you certify that you are at least 18 years old or that you are the parent or legal guardian of the child/children listed on the registration. Unless you have notified us otherwise, you also give your child permission to access many areas of the BlueGolf Sites related to the registration, including email, message boards and other registration related information. Please remember that the BlueGolf Sites and BlueGolf services are intended to apply to a broad audience. Accordingly, as the parent or legal guardian, it is your responsibility to determine whether any of the BlueGolf Sites areas and/or content are appropriate for your child.
Registration data and certain other information about you is subject to BlueGolf's Privacy Policy located at: https://www.bluegolf.com/legal/privacy.html. Through your use of the BlueGolf Sites and related services you consent to the collection and use (as set forth in the Privacy Policy) of certain information about you, including the transfer of this information to the United States and/or other countries for storage, processing and use by BlueGolf and its affiliates.
Charges and Billing For Certain BlueGolf Sites. Certain of the BlueGolf Sites require payment of access fees. By registering for those BlueGolf Sites, you hereby authorize BlueGolf and/or a customer of BlueGolf with whom you are registering for services ("Customer") to charge your credit card in advance for all applicable fees incurred by you in connection with your chosen service and registration for your account. You hereby understand and agree that in most cases, BlueGolf or Customer, as the case may be, will be charging your designated credit card in accordance with the payment schedule of the service for which you have registered, but some service fees may accumulate on your credit card account before they are actually charged to your credit card. You further understand and agree that it is your responsibility to notify BlueGolf and Customer of any changes to your credit card or if your credit card has expired otherwise your access to the Service may be disconnected or interrupted. All fees shall be paid in U.S. dollars.
BlueGolf reserves the right to change any fees (which includes but is not limited to, charging a fee for packages, options, upgrades and/or a Service for which BlueGolf does not currently charge a fee) or billing methods at any time, provided, however, that such modifications shall not take effect earlier than thirty (30) days after BlueGolf posts such modification on the applicable BlueGolf Site(s). You may cancel your Account or any associated optional or upgraded services therefore at any time, but BlueGolf will not refund any remaining portion of your pre-paid fees and you may be charged an additional cancellation fee.
You agree to pay your Account balance on time. You also agree to pay any taxes, including sales or use taxes, resulting from your use of the Service. You are responsible and liable for any fees, including attorney and collection fees, that BlueGolf and/or Customer, as the case may be, may incur in its efforts to collect any remaining balances due from you. This section titled Charges and Billing For Certain BlueGolf Sites shall in no way limit any other remedies available to BlueGolf and Customer. You also understand and agree that you will be billed for and will pay any outstanding balances if you cancel your account or your account is terminated. You must notify BlueGolf of any billing problems or discrepancies within sixty (60) days after they first appear on your statement. If you do not notify BlueGolf within sixty (60) days, you waive any right to dispute such problems or discrepancies.
BlueGolf does not represent or guarantee the truthfulness accuracy, or reliability of any communications posted by other users or endorse any opinions expressed by users. You acknowledge that any reliance on material posted by other users will be at your own risk.
BlueGolf does not screen communications and is not responsible for screening or monitoring material posted by users. BlueGolf may, at any time, in its sole discretion, remove or request the removal of any communication or material posted to this site. BlueGolf has no liability or responsibility to users for performance or non-performance of such activities. BlueGolf reserves the right to terminate any user's access to this site for violating these Terms of Use or the law.
Publishers of news items do not generally obtain releases from subjects, individuals, groups or entities that are shown in their photographs or graphics or quoted in their texts. Also, no clearance is obtained from the owners of trademarks or copyrighted materials whose marks or materials are included in news items. Therefore, you will be solely responsible for obtaining any and all necessary releases if you use news items that you find on this site. Neither BlueGolf nor any other publisher or news service will be liable for any delays, inaccuracies, errors or omissions in any news material or in the transmission or delivery of all or any part thereof or for any damages arising from any of the foregoing.
Neither BlueGolf, its affiliates, nor any third-party content providers or licensors makes any representations or warranties whatsoever, including without limitation: that the operation of the BlueGolf Sites will be uninterrupted or error-free; that any defects, viruses or other harmful components will be corrected; that the BlueGolf Sites, including the server that makes it available, is free of viruses, defects or other harmful components; as to the results that may be obtained from use of the materials on the BlueGolf Sites; or as to the accuracy, reliability, availability, suitability, quality, or operation of any information, software, or service provided on or accessible from the BlueGolf Sites.
BLUEGOLF AND ALL INFORMATION, PRODUCTS AND OTHER CONTENT (INCLUDING THIRD-PARTY INFORMATION, PRODUCTS AND CONTENT) INCLUDED ON OR ACCESSIBLE FROM THE BLUEGOLF SITES ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND (EXPRESS, IMPLIED AND STATUTORY, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF TITLE AND NONINFRINGEMENT AND THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE), ALL OF WHICH BLUEGOLF DISCLAIMS TO THE FULLEST EXTENT PERMITTED BY LAW. YOUR USE OF THE BLUEGOLF SITES IS AT YOUR SOLE RISK.

You agree to defend, indemnify and hold harmless BlueGolf, its directors, officers, shareholders, parents, subsidiaries, affiliates, partners, agents, contractors, employees and licensors, from and against any and all claims, demands, losses, liabilities and/or expenses and the like (including reasonable attorneys' fees) of, relating to or arising from your use of BlueGolf services; your use of the BlueGolf Sites; your violation of these Terms of Use; your breach of any warranty and/or representation made by you; content you submit, post, transmit or otherwise make available through BlueGolf Sites; or any other infringement, breach and/or violation committed by you, of any right, benefit or interest of any person or entity, including without limitation, any intellectual property rights.
BlueGolf reserves the right, in its sole discretion, to immediately and without any prior notice to suspend or terminate (i) these Terms of Use; (ii) your registration with or ability to access the BlueGolf Sites and/or any other service provided to you by BlueGolf upon; (a) any breach by you of these Terms of Use or upon any conduct by you that BlueGolf determines to be inappropriate; (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account deletions), (d) discontinuance or material modification to the BlueGolf Sites and/or BlueGolf services (or any part thereof), (e) unexpected technical or security issues or problems, (f) extended periods of inactivity, (g) engagement by you in fraudulent or illegal activities, and/or (h) nonpayment of any fees owed by you in connection with the Services. Where your account or registration with BlueGolf is terminated, you may be required to forfeit any credits, pre-paid fees, and any other amounts collected as part of your use and registration of the BlueGolf Sites. BlueGolf shall not be required to refund, redeem or pay any such amounts to you, and you shall remain liable to BlueGolf for any charges, fees, commitments, and obligations incurred by you prior to such termination. All records, information, messages, content and other information related to your registration and account may also be deleted by BlueGolf in its sole discretion without any notice or liability to you. BlueGolf shall not be liable to you or any third party for any termination of your account, any associated account related or identifying information, or access to the BlueGolf Sites and/or BlueGolf services.
These Terms of Use are governed by the laws of the United States and the Commonwealth of Pennsylvania, without giving effect to any principles of conflicts of laws. You agree that exclusive jurisdiction for any dispute with BlueGolf, or in any way relating to or arising from your use of the BlueGolf Site and/or matters involving the Terms of Use resides solely in the courts of the Commonwealth of Pennsylvania and, in furtherance thereof, you agree and expressly consent to the exercise of personal jurisdiction in the courts of the Commonwealth of Pennsylvania in connection with any such dispute, including without limitation, any claim of or involving BlueGolf or its affiliates, subsidiaries, employees, contractors, directors and officers. If any provision of these Terms of Use shall be unlawful, void or for any reason unenforceable, then such provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.
BlueGolf reserves the right at any time and from time to time to modify, amend and/or discontinue, temporarily or permanently, these Terms of Use, the BlueGolf Sites (or any part thereof), with or without notice. BlueGolf shall not be liable to you or to any third-party for any modification, suspension or discontinuance of its services and/or any of the BlueGolf Sites. The failure of BlueGolf to insist upon or enforce strict performance by you of any provision of the Terms of Use or to exercise any right under the Terms of Use will not be considered as a waiver or relinquishment to any extent of BlueGolf's right to assert or rely upon any such provision or right in that or any other instance, rather, the same will be and remain in full force and effect. BlueGolf may assign any or all of its rights, benefits and/or obligations under these Terms of Use and upon such assignment, BlueGolf shall be relieved of any further obligation hereunder. You represent and warrant to BlueGolf that you have the authority to register with BlueGolf according to these Terms of Use. Further, you represent and warrant to BlueGolf that any data from any third party that you access through the BlueGolf Sites, or that BlueGolf accesses on your behalf, is permissible and does not violate, infringe and/or breach any rights and/or benefits of any person or entity and/or any restrictions imposed by any person or entity.
