We are Kiel Center Partners, L.P., doing business as Enterprise Center (the “Arena”) and are the operator of the web sites located at the uniform resource locators (“URLs”) www.enterprisecenter.com and www.enterprisecenter.net (the “Sites”). This Privacy Policy (the “Privacy Policy”) covers the Arena’s treatment of personally identifiable information and non-personally identifiable information that the Arena collects when you are on any of our Sites and when you use the Site Features (as defined in the Agreement on Terms and Conditions of Use). This policy does not apply to the practices of companies that the Arena does not own or control, or to people that the Arena does not employ or manage.

By accessing or using any of our Sites, you are and shall be bound by, and you agree to the collection and use of your personally identifiable information as set forth in, this Privacy Policy. If you do not agree with any part of our Privacy Policy – including the collection and use of your personally identifiable information as described below – do not access or use our Sites.

The Information We Collect

On our Sites, you can enter contests and participate in other promotional events, vote in polls or otherwise express an opinion, subscribe to one of our services (including our online newsletters and email lists), or participate in our online forums. The types of personally identifiable information that may be collected on these pages include your email address and information about your interests in and use of various products, programs and services. In addition, registration is required and information is collected in certain areas of our Sites in which users provide content submissions and suggestions or participate in interactive online activities.

We also may collect certain non-personally identifiable information when you visit our Sites, such as the type of browser you are using, the type of operating system you are using and the domain name of your Internet service provider. Generally, “non-personally identifiable information” may be collected through “traffic data” and may entail the use of “Cookies”, “IP addresses” or other numeric codes used to identify a computer or monitor how a user accesses a website.

How We Use the Information

We may use the information you provide about yourself to fulfill your requests for our products, programs, and services, to respond to your inquiries about our offerings, and to offer you other products, programs or services that we believe may be of interest to you.

We may also use this information to communicate with you, such as to inform you about upcoming events or recent news, to notify you when you have won one of our contests, to fulfill a request by you for an online newsletter, or to contact you about your account with us.

We may use the non-personally identifiable information that we collect to improve the design and content of our Sites and to enable us to personalize your Internet experience. We also may use this information in the aggregate to analyze site usage, as well as to offer you products, programs, or services.

The Arena collects IP addresses for the purposes of system administration and to report aggregate information (e.g., how many visitors visit our Sites) to our advertisers. Web servers automatically identify your computer by its IP address (an IP address is a number that’s automatically assigned to your computer whenever you’re surfing the Web). When users request pages from our Sites, our servers log the users’ IP addresses. We do not link IP addresses to anything personally identifiable. As a result, a user’s session will be logged, but the user remains anonymous to us.

We may disclose personally identifiable information of any user: (i) if such information is subpoenaed or the Arena, in its sole discretion, believes that disclosure is otherwise required to comply with a court order or legal process, (ii) if the Arena, in its sole discretion, believes that such user is violating our Agreement on Terms and Conditions of Use or is using any of our Sites to commit unlawful acts or acts that endanger the general public or that disclosure is permitted or required by law to protect the security of our Sites or to otherwise protect our rights or to take precautions against liability, (iii) if the Arena elects to work (and, by necessity, share information) with third party providers of internet support-services in order to assist the Arena in collecting information on our Sites or in order to provide other services or goods relating to our Sites, or (iv) in association with any transfer of our business or assets.

Users should be aware that, when they voluntarily disclose personally identifiable information on the bulletin boards or in the chat areas of our Sites, that information, along with any substantive information disclosed in the user’s communication, can be collected and used by third parties. The Arena has no control over any such use of any information by third parties.

Use of Cookies

Cookies are pieces of information that a website transfers to an individual’s hard drive for record keeping purposes. The use of cookies is standard on the internet and many major websites use them. Our Sites use cookies to show us how often users access certain portion of our Sites. The Arena does not use cookies to retrieve information from your computer that was not originally sent in a cookie. Except as described below, the Arena does not use information transferred through cookies for any promotional or marketing purposes, nor does it share such information with any third parties whatsoever.

We do not control any cookies of any advertiser sites or linked sites, and our Privacy Policy does not apply to them. If you have questions concerning the use by any advertiser site or linked site of cookies or about any other issues relating to that site’s collection, use and distribution of personally identifiable information, then you should review any privacy policy and any other terms and conditions maintained by that site. You may also direct any questions or concerns to the advertiser site’s or linked site’s website administrator or as otherwise directed by such site.

Most browsers are initially set to accept cookies. If you’d prefer, you can set yours to refuse cookies or to alert you when cookies are being sent. However, some parts of our Sites may not function properly if you do so.

Children’s Privacy Policy

As part of the registration process, you will be asked to provide your date of birth, and you are required to provide your actual date of birth. The Arena does not accept information from children under the age of 13. When a child under the age of 13 attempts to submit his or her registration information, our Sites will reject the submission.

Policies for Individuals 13 Years of Age or Older

By submitting information, individuals 13 years of age or older agree that such information may be used for marketing and promotional purposes by the Arena. Generally, the Arena will not share such information with third parties unless otherwise disclosed during collection. If a user objects to such use for any reason, such user may stop that use – either by modifying such user’s registration information, by canceling a registration and then re-registering, or as otherwise directed by our Sites.

Security

We have put in place appropriate electronic and other procedures to safeguard and help prevent unauthorized access, maintain data security, and correctly use the information we collect on our Sites.

Although we take appropriate measures to safeguard against the unauthorized disclosure or use of information we collect on our Sites, we cannot assure you that personally identifiable information that we collect will never be disclosed in a manner that is inconsistent with our Privacy Policy.

Opting Out

After gathering any user information, the Arena offers users the opportunity to remove their information from our active database in order to stop receiving future communications from us via our Sites.

Miscellaneous

The Arena reserves the right to change this Privacy Policy at any time by posting any such change on our Sites. The terms and provisions of the Agreement on Terms and Conditions of Use are hereby incorporated in this Privacy Policy by reference. This Privacy Policy, and all claims or issues regarding any of our Sites, shall be governed according to the laws of the State of Missouri, without giving effect to any principles of conflicts of law. Except as otherwise required by law, any legal action concerning this Privacy Policy or any of our Sites must be brought within one (1) year after the claim or cause of action arises and must be brought in the State of Missouri. You hereby waive any argument that any such court does not have jurisdiction over you or such dispute or that venue in any such court is not appropriate or convenient. If any part of this Privacy Policy is deemed invalid or unenforceable according to applicable law, the remainder of this Privacy Policy shall continue in effect. Our failure to insist upon strict enforcement of any provision of this Privacy Policy shall not be construed as a waiver of any provision or right.
