  • FREE SPEECH WIN: In 2021, Dr. David Phillips was abruptly fired for doing his job: teaching students to think for themselves about ideas like critical theory. This week, the North Carolina Governor’s School agreed to pay Dr. Phillips approximately four years of his annual stipend—and adopted a new free speech policy. That’s the outcome of a lawsuit we helped Dr. Phillips file against North Carolina public school officials. For eight summers, Dr. Phillips taught at the Governor’s School, a residential summer program for the state’s most talented rising high school seniors. He was a beloved, respected professor with glowing performance reviews. But over the years, he noticed that the school was steadily abandoning its commitment to free inquiry, open debate, and viewpoint diversity. Instead, racially divisive ideologies were beginning to dominate. This culminated in June 2021, when Dr. Phillips offered a series of optional seminars critiquing critical theory and the increasing lack of viewpoint diversity in higher education. Although he had offered these seminars in the past with no complaints, this time he was met with open hostility from a group of students and staff in attendance. The very next day, North Carolina public school officials fired him without any warning or explanation. “Teachers shouldn’t be fired for fostering intellectual diversity on campus. A good education includes providing students with a wide range of differing viewpoints to explore,” said ADF Senior Counsel Hal Frampton. “Now, the Governor’s School’s policy rightly respects teachers’ freedom of speech, which greatly benefits all students and families.” We are pleased to favorably settle this case on behalf of Dr. Phillips—and on behalf of students who deserve an environment of real intellectual diversity.

  • Today, Idaho stood up for life and the rule of law—and we were proud to stand with them. Speaking before the U.S. Supreme Court, the Idaho Attorney General’s office eloquently defended the constitutional principles at stake. “The [Biden] administration’s position ultimately is untethered from any limiting principle,” pointed out attorney Josh Turner, who argued the case. “There’s just no way to limit this to abortion, and there’s no way to limit it to Idaho. . . . This question is going to come up in state after state after state. . . . [It] is hugely concerning if the federal government can pay private actors to violate state laws. . . . The implications of that are vast. It leaves the federal government unbound by enumerated powers.” As the Biden admin attempts to abuse federal power, Idaho is standing firm. Its law protects and provides life-saving care for EVERYONE—both pregnant women and their unborn children. It’s right in line with EMTALA. It reflects the will of the people. It affirms the truth: that life is a human right. #IdahoProtectsLife
