Pursuant to the terms of a deed of trust dated April 17, 2014, in the original principal amount of $136,285.00, recorded in the Clerk's Office of the Circuit Court of the City of Hampton, Virginia, as Instrument No. 140004405, as assigned to Noteholder by Assignment recorded as Instrument No. 140006656, the property briefly described below will be offered for sale at public auction:
Lots 135 and 137 in Block 8, as shown on that certain plat entitled "Plat of Monroe Colony", made by Girard Chambers, C.E. and filed in the Clerk's Office of the Circuit Court of the City of Hampton (formerly Elizabeth City County), Virginia with and as part of the report of T.L. Selater, Commissioner in Chancery in the Chancery Cause Etta V. Henley, et als v. Elizabeth B. Taylor, et als.
The sale will take place on May 6, 2024 AT 3:00 P.M., at the front entrance to the building housing the Circuit Court of the City of Hampton, located at located at 237 N. King Street, Hampton, VA. The undersigned reserves the right to suspend bidding and/or to adjourn the bidding prior to the completion of sale.
The property and the improvements thereon will be sold "AS IS" and without representation or warranties of any kind. The sale is subject to all liens, encumbrances, conditions, easements and restrictions, if any, superior to the mentioned deed of trust and lawfully affecting the property.
Terms: A deposit in the form of CERTIFIED FUNDS in the amount of $10,000.00 (CASH NOT ACCEPTED) or 10% of the successful bid, whichever is lower, is required of any bidder at the time of sale. Closing within fifteen (15) days of sale. If the payment of the balance does not occur within fifteen days of sale, the deposit shall be retained by the Trustee as liquidated damages. Time is of the essence. Trustee has no duty to obtain possession for purchaser. The risk of loss or damage to the property passes to the purchaser immediately upon conclusion of the Substitute Trustee's sale. Purchaser to pay all closing costs, including cost of Trustee's Deed.
