Delhi Chief Minister Arvind Kejriwal: Delhi’s Rouse Avenue Court has extended CM Arvind Kejriwal’s Enforcement Directorate (ED) custody by four days till April 1. The ED had sought a 7-day extension on the AAP national convener’s custody in the now-scrapped liquor policy case. Kejriwal, who was produced in court, responded to a media query on Delhi L-G VK Saxena’s ‘government cannot run from jail’ remark, saying that “this is a political conspiracy. The public will give a befitting reply.”

Kejriwal’s appearance in the court Thursday has triggered more buzz as his wife, Sunita Kejriwal, said that he will then do a “big expose” on the alleged liquor policy scam. AAP leaders Atishi, and his wife Sunita were present in the courtroom for his remand hearing. Meanwhile, the Delhi High Court dismissed a plea seeking removal of Arvind Kejriwal from the post of Delhi’s Chief Minister, saying that there is “no scope of judicial interference” in the matter. Earlier, AAP leader Saurabh Bharadwaj hit out on the Bharatiya Janata Party saying they received information that the BJP is trying to “poach AAP MLAs by luring them with money, Y plus security and even MP seat.”

What’s next for AAP? If Kejriwal does not get relief from the courts soon enough, the AAP is likely to face an existential crisis as it will in the short term lose the services of a leader who has no peer in the party in terms of mass appeal. This is likely to pose a serious challenge to the party and in a state like Punjab, it may even make voters sway more towards the Congress.

Here's what the Delhi court said as it extended Kejriwal's ED custody till April 1

"Having considered the submission made before this court and considering the grounds as cited by the investigative agency, there appears to be sufficient reasons to permit further custodial interrogation, particularly keeping in view the submissions that he (Kejriwal) is required to be confronted with the material collected and statements recorded so far in the course of the investigation," special judge Kaveri Baweja said.

The court noted the ED's submissions that the chief minister also needed to be confronted with the data extracted from digital devices along with some other details.

"On perusal of the statements recorded in the course of the investigation and in view of the fact that extension of custodial interrogation of the accused has been sought for further sustained and detailed interrogation, the ED custody of the accused (Kejriwal) is hereby extended till April 1," the court said.

It noted that after Kejriwal was allowed to make verbal submissions, he stated about being ready to cooperate with the agency, besides not opposing the ED's plea for remand extension.

"He further submitted in the open court during the proceedings that statements of witnesses recorded by the investigating agency do not in any manner connect him with the alleged offences and questioned his arrest in the matter," the court noted.

It also noted Kejriwal's submissions that the ED was not placing all documents especially those that favoured him, before the court and that the ED was unable to establish the whereabouts of the alleged Rs 100 crores received as "kickbacks." "Accused (Kejriwal) has further submitted that one of the witnesses had donated a large sum of money to the BJP," the court noted.

It also noted the submissions of ED's counsel, Additional Solicitor General S V Raju, that Kejriwal's statement were "wholly irrelevant and unconnected with the facts of the present case, as also with the predicate offences." According to the ASG, the matter was presently not at the stage of being adjudicated and hence, the above submissions were wholly irrelevant at this point of time, the court noted.

"He (ASG) further submitted that there is also no merit in the submissions that the ED has not placed on record the material favouring the accused and questioned as to how the accused has knowledge about documents in the custody of ED," the court said.

It said that according to the ASG, "selective submissions" were made by Kejriwal and that there was "sufficient material to show the money trail of the proceeds of crime" generated as kickbacks in the scam and that Rs 45 crore sent through hawala and utilised by the AAP in the 2021-22 Goa assembly elections.

The court also noted the submissions of Kejriwal's counsel, Senior Advocate Ramesh Gupta. He said his client was willing to cooperate with the agency, but the ED was not entitled to seek his remand based on their application.

"In so far as the submissions with respect to there not being sufficient grounds for arrest of the accused are concerned, the said matter is admittedly subjudice before the Delhi High Court in a petition wherein the accused has challenged the grounds of his arrest," the court said.

‘No scope of judicial interference’: Delhi High Court dismisses PIL seeking removal of Kejriwal as CM

 The Delhi High Court dismissed a a PIL seeking removal of Arvind Kejriwal from the post of Delhi’s Chief Minister, saying that there is “no scope of judicial interference” in the matter.

“There is no scope for judicial interference vis a vis the relief sought (of removal of Kejriwal from CM’s post). It is for the other wing of the government to examine this issue in accordance with law. This court clarifies that it has not commented on the merits of the case,” the bench said.

The PIL was filed by one Surjit Singh Yadav which also called upon the Centre, State of Delhi through Chief Secretary and the Principal Secretary to the lieutenant governor to answer under what authority Kejriwal is holding the post of Chief Minister.

Cong's plea against tax re-assessment by IT authorities dismissed by HC

The Delhi High Court on Thursday rejected petitions by the Congress challenging the initiation of tax reassessment proceedings against it for a period of four years by tax authorities.

A bench of Justices Yashwant Varma and Purushaindra Kumar Kaurav said the pleas were dismissed in terms of its earlier decision refusing to interfere with the opening of re-assessment for another year.

The present matter pertained to assessment years 2017 to 2021.

'AAP leaders getting calls to leave party': AAP's Sandeep Pathak

India has summoned a senior US diplomat and registered a strong protest against Washington's comments on the arrest of Arvind Kejriwal. Ministry of External Affairs (MEA) officials summoned the Acting Deputy Chief of Mission Gloria Berbena at its office. Later in a statement, the ministery said, "We take strong objection to the remarks of the Spokesperson of the US State Department about certain legal proceedings in India. The Arvind Kejriwal arrest is different from the arrests of other Opposition leaders that the Enforcement Directorate (ED) has made of late. Will its timing, coming less than a month before the general elections raises several issues.

The Narendra Modi government may hope to ride out whatever storm the ED’s custody of the Delhi Chief Minister in the excise policy scam may generate, with the AAP workers hitting the streets in protest. From the first murmurings from the ground, people, including even those who don’t particularly like Kejriwal or his politics, see it as “zyadati” (excessive). “Thora zyada hee ho raha hai, (It’s a little too much),” they say, with a tone of worry.

In its remand application, the ED has alleged payoffs for the Goa polls from a South group facilitated by Kejriwal, his office and his aides. Also, the fact that Central agencies are overwhelmingly knocking on Opposition doors has not exactly triggered outrage at the popular level even as it has united the Opposition leaders. The fact that all “targets” have corruption complaints is certainly one reason. But how will people react to putting a sitting CM in jail in the middle of polls and watch what should be a level-playing field become an uneven one – eliminating the Opposition figures to the advantage of the ruling party?

After Delhi Chief Minister Arvind Kejriwal issued orders to Health Minister Saurabh Bharadwaj while being in ED custody, Union Health Minister Mansukh Mandaviya in response told ANI, "Today he (Arvind Kejriwal) has to worry about the health of people of Delhi, but there is no implementation of 'Ayushman Bharat' in the Capital...They should increase the number of beds in the hospital; the immunisation of the children of Delhi is less compared to others, discuss that as well. The performance of Delhi is very poor in the TB elimination programme, which is underway across India...In the National Capital, for the last many years, the number of medical colleges has not transcended and so as the medical seats. The attempts that are made by him (Arvind Kejriwal) to gain sympathy will not be successful."

Arvind Kejriwal Arrest Live Updates: 'Not reserving matter without hearing ED', says HC; order to be passed at 4:30 pm

After hearing arguments made by ASG Raju and Arvind Kejriwal's lawyer, the High Court said an order will be passed between 4:30 pm and 4:45 pm. 'I am not reserving the matter without hearing ED,' the HC said.

Additional Solicitor General SV Raju opposed three lawyers appearing for Kejriwal. He said that there should be a level playing field adding that if three counsels are appearing for Kejriwal then he will request for three counsels to appear for ED . 

Senior advocate Amit Desai also appearing for Kejriwal said that that the senior counsels had divided their arguments, and he was only going to supplement singhvi’s arguments.

'My first submission is that in interim relief I have to be heard. And I have to file a reply to it. The right to be heard includes right to file a reply,' ASG Raju said on behalf of ED.

Raju further said, 'We asked them for a copy, we had sent them emails on Sunday and Monday asking for a copy. They deliberately did not provide us. Please see defects to the petition- one on typed copy of annexure and one on service. Nothing prevented them from giving us a copy subject to objection. Where is the level playing field here? What defect are these as good as useless defects. If they wanted an early hearing it was their duty to give us a copy. If they wanted a genuine fair hearing they could have sent us a copy of the plea on Saturday itself, and given us an opportunity to prepare. If interim relief is granted it will tantamount to granting relief in main petition, thats why I will need more time to prepare.'

Arvind Kejriwal Arrest Live Updates: Delhi govt will not be run from jail, says Lt Governor VK Saxena

The government will not be run from jail, Delhi Lieutenant Governor V K Saxena said on Wednesday in the backdrop of statements by AAP leaders that Arvind Kejriwal will continue as chief minister even if he is behind bars.

Aam Aadmi Party (AAP) national convener Kejriwal was arrested by the Enforcement Directorate on March 21 in the Delhi excise policy-linked money laundering case and subsequently remanded to the agency’s custody till March 28 by a court here.

Speaking at the Times Now Summit, Saxena said, “I can assure the people of Delhi that the government will not be run from jail.”

Singhvi, lawyer appearing for Kejriwal told HC, "This is a case of complete vicarious liability. you cannot subsume definition of political party given in representation of people’s act-in the PMLA when the PMLA does not refer to a political party. You are doing violence to both statutes."

"ED is frozen in time in giving the court grounds of arrest. In criminal law grounds of arrest are frozen. That freeze has been superimposed and interpreted by remand order. I beesech my lord, this is a matter where democracy itself is involved, basic structure, level playing field is involved. A day is far too long when the arrest is illegal. ED is achieving its nefarious object to by seeking more time," Singhvi further said.

Arvind Kejriwal Arrest Live Updates: Singhvi refers to SC judgment on Manish Sisodia's case

Singhvi referred to Supreme Court's judgement in Manish Sisodia's case. Singhvi told Delhi HC, "The last point which has already been decided in my favour in Sisodia's case...which ED is persisting on Kejriwal. Their point is that they want Kejriwal to find out more about the flow of proceeds of crime which is quantified to be 45 crore." The Supreme Court had rejected the matter in Sisodia's case, Singhvi said.

Arvind Kejriwal Arrest Live Updates: Little weight be given to statements made by co-accused, says Singhvi

Singhvi, Kejriwal's lawyer told Delhi HC, "Its so easy to extract incrimination out of statements made by co-accused, because they are worried about themselves. Therefore very little weight should be given to such statements made by co-accused. Such statements should not be taken as a substantive evidence, unless there is clear corroboration. 

"Pardon bail has been given to the co-accused who are ED’s star witnesses. There is no corroboration in such matters," Singhvi said.

Singhvi has referred to statements made by Aurobindo Pharma Director P Sarath Chandra Reddy. He says that ED did not object to the ground that he was sick and infirm. He subsequently makes statements after he is released and the statement was contrary to those made earlier.

“Sarath Reddy continues to not stand against me (kejriwal) in 9 statments. This is shocking. These 9 statements are not put in any of the ED’s 6 complaints...Making a mockey of fairness...On 25/4/2023, one and half years after original statement was made Sarath Reddy makes a statement against me. Thereafter he gets bail on medical ground and subsequently he gets a pardon,” Singhvi said.

‘Kejriwal must resign’: BJP leaders hit Delhi’s streets; 58 detained

Marching from Feroz Shah Kotla to the Delhi Secretariat, the Delhi BJP Tuesday demanded that Chief Minister Arvind Kejriwal, arrested in the excise policy case, must resign and denounce his intents to continue his term from behind bars. Amid slogans like “Kejriwal Dilli chodo”, banners with messages like “Kejriwal sharam karo” dotted the rally, which was led by state BJP president Virendra Sachdeva. As they were on their way to the Delhi Secretariat, the protest was met by police water cannons. Around 58 protesters were later detained, said police.

Condemning Kejriwal’s insistence on “clinging to power” amid corruption allegations, Sachdeva said: “The way Kejriwal is insisting on continuing as the Delhi CM from jail, he is not only violating political ethics but also showing that he considers the government and the party his personal fiefdom… (He) is not the first ruling political leader to be arrested on corruption charges. Recently, Jharkhand CM Hemant Soren faced similar action… Tamil Nadu CM Jayalalithaa was also arrested on corruption charges, but both resigned. Internationally, we have examples of various prime ministers like that of Pakistan, Japan and Italy… where they resigned after facing action against corruption charges.”
